Terms of Service

1. Acceptance of Terms

By accessing or using the SuperScout platform (www.superscout.co.za), operated by Go Live AI (Pty) Ltd (registration 2025/951591/07), trading as SuperScout, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the platform immediately.

These Terms constitute a legally binding agreement between you ("User", "you") and Go Live AI (Pty) Ltd ("we", "us", "SuperScout") in accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

2. Service Description

SuperScout is an AI-powered recruiting platform that provides the following services:

• CV Analysis & Scoring: Automated analysis of candidate CVs against job descriptions using artificial intelligence.
• Candidate Ranking: AI-generated scores across experience, skills, education, and cultural fit dimensions.
• AI Chat Assistant: An AI-powered assistant ("Scout") that allows recruiters to query and compare candidate profiles conversationally.
• Project Management: Tools to organise recruitment projects, upload documents, and manage candidate pipelines.

3. Account Registration

To use SuperScout, you must create an account. By registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorised use of your account.

You must be at least 18 years of age to create an account and use our services.

4. Credits, Top-Ups and Payment

4.1 Pay-as-you-go

SuperScout is pay-as-you-go. You create a free account and receive 1 000 credits, enough for one analysis. There is no subscription, no seat fee and no recurring charge.

4.2 Buying credits

Credits are bought as wallet top-ups:

• R3 000 for 3 000 credits
• R7 000 for 8 000 credits (including 1 000 bonus credits)
• R12 000 for 15 000 credits (including 3 000 bonus credits)
• R20 000 for 30 000 credits (including 10 000 bonus credits)

Prices are in South African Rand and include VAT where applicable. Payments are processed by PayFast; we do not store card details.

4.3 What credits pay for

Each analysis deducts 1 000 credits. One analysis covers one job description and the CVs uploaded for it. AI voice screening interviews deduct 20 credits per minute of completed interview time. Current prices and credit costs are shown on the website and in your wallet before you confirm a top-up. We may change them for future top-ups with notice on the website, and credits already in your wallet keep their stated value.

4.4 Expiry

Credits do not expire while your account is open.

4.5 Refunds

Unused paid credits may be refunded on written request to info@go-liveai.com, less any payment processing fees. Bonus credits have no cash value and are not refundable. Credits already used are not refundable. Nothing in this section limits your rights under the Consumer Protection Act 68 of 2008.

4.6 Account closure and termination

Closing your account forfeits any remaining credits, so request a refund of unused paid credits before you close it. If we terminate your account for breach, unused paid credits are refunded on the same basis unless the breach involved fraud or abuse.

4.7 Disputed payments

Disputed or reversed payments suspend the wallet until the dispute is resolved. Credits from a reversed payment are removed.

4.8 Transaction history

Every top-up and deduction is listed in your wallet transaction history.

5. Acceptable Use Policy

You agree not to use SuperScout to:

• Upload malicious, fraudulent, or unlawful content.
• Attempt to gain unauthorised access to our systems, other users' accounts, or data.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Scrape, crawl, or use automated means to extract data from the platform.
• Use the platform for discriminatory hiring practices in violation of applicable employment laws.
• Upload candidate CVs without the necessary legal basis or consent to do so.
• Interfere with the platform's operation or impose unreasonable loads on our infrastructure.
• Resell, sublicense, or redistribute access to SuperScout without our written consent.

You confirm you have the right to upload each CV and to invite each candidate to a voice screening interview.

6. Intellectual Property

6.1 Our Property

The SuperScout platform, including its software, design, logos, AI models, algorithms, and documentation, is the intellectual property of Go Live AI (Pty) Ltd. All rights are reserved. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding.

6.2 Your Content

You retain ownership of all content you upload to SuperScout, including CVs, job descriptions, and project data. By uploading content, you grant us a limited, non-exclusive licence to process, store, and analyse that content solely for the purpose of delivering our services to you.

7. User Content and Data Responsibility

As a user of SuperScout, you are responsible for:

• Ensuring you have the legal right and/or consent to upload candidate CVs and personal information to the platform.
• Complying with all applicable data protection laws, including POPIA and GDPR, when handling candidate data.
• Informing candidates that their CVs may be processed by AI-powered tools as part of the recruitment process.
• The accuracy and legality of all content you upload.

8. AI-Generated Output Disclaimer

SuperScout uses artificial intelligence to analyse CVs, generate candidate scores, and provide insights. You acknowledge and agree that:

• AI-generated scores, summaries, and recommendations are advisory in nature and should not be the sole basis for hiring decisions.
• AI outputs may contain inaccuracies, biases, or errors. You are responsible for independently verifying all AI-generated information.
• We do not guarantee the accuracy, completeness, or suitability of any AI-generated output.
• Hiring decisions remain your sole responsibility. SuperScout is a tool to assist, not replace, human judgment in recruitment.

9. Limitation of Liability

To the maximum extent permitted by South African law, including the Consumer Protection Act 68 of 2008 (CPA):

• SuperScout is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SuperScout.
• Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
• We are not liable for any hiring decisions made based on AI-generated outputs, nor for the suitability of any candidate.

10. Indemnification

You agree to indemnify, defend, and hold harmless Go Live AI (Pty) Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the platform in violation of these Terms.
• Your violation of any applicable law or regulation.
• Your upload of candidate data without proper consent or legal basis.
• Any claim by a third party related to content you uploaded to SuperScout.

11. Termination

We reserve the right to suspend or terminate your account at any time if:

• You breach any provision of these Terms.
• We are required to do so by law.
• Your use of the platform poses a risk to other users or our infrastructure.
• Your account has been inactive for an extended period.

Upon termination, your right to use SuperScout ceases immediately. We may retain certain data as required by law or as outlined in our Privacy Policy.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

13. Dispute Resolution

In the event of a dispute arising from these Terms or your use of SuperScout:

• Step 1: Informal Resolution: You agree to first attempt to resolve the dispute informally by contacting us at info@go-liveai.com.
• Step 2: Mediation: If informal resolution fails within 30 days, the dispute shall be referred to mediation in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
• Step 3: Litigation: If mediation fails, either party may pursue the matter in the courts of South Africa.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page with a revised "Last updated" date.
• Sending an email notification for significant changes that affect your rights or obligations.

Continued use of SuperScout after changes are posted constitutes acceptance of the revised Terms.
